Florida now requires many HOAs and condo associations to have a website. That website also needs to work for owners with disabilities. Associations that overlooked this have received demand letters and lawsuits, and fixing it is far easier than defending a claim.

Is website accessibility optional?

No law spells out exact accessibility rules for HOA and condo websites. But that does not make accessibility optional.

Florida associations have been targeted with demand letters and lawsuits claiming their websites shut out people with disabilities, under both the Americans with Disabilities Act (ADA) and the Fair Housing Act. These claims are expensive to defend, and associations are often asked to pay the other side’s legal fees even after they fix the website. The U.S. Department of Justice has also said that businesses open to the public should make their websites accessible.

The safest approach is to treat accessibility as a must, not a nice to have. If your board has questions about its own situation, ask your association attorney.

The standard to follow

The widely accepted standard is the Web Content Accessibility Guidelines (WCAG) 2.1, Level AA. These are guidelines that make websites easier to use for people who are blind, have low vision, are deaf, or have trouble using a mouse.

The U.S. Department of Justice requires this standard for city, county and state government websites, with deadlines in April 2027 and April 2028. That rule doesn’t cover HOAs or condos, but it shows which standard officials and courts look to.

Why it matters to your owners

Your website holds official records that every owner has a right to see. An owner who is blind and uses a screen reader (software that reads the page out loud) should be able to open the budget just like anyone else.

Simple ways to make your website easier to use

These basics make a big difference:

  1. Describe your images with short text, so screen readers can tell users what’s in them.
  2. Upload searchable PDFs, not scanned pictures of documents. A scanned page is just an image, and a screen reader can’t read it.
  3. Use strong color contrast and clear headings, so pages are easy to read and scan.
  4. Make sure the site works with a keyboard, for owners who can’t use a mouse.
  5. Add captions to videos, which is especially helpful if your condo posts meeting recordings.

Tip: check each document before you upload it. It’s much easier than fixing everything at once later.
